Conformed contract
The term "conformed contract" refers to the version of the contract that has been updated to include all agreed changes, amendments, and variations made during the negotiation and execution phases. This updated document represents the final and authoritative version of the contract, reflecting the true and complete agreement between the parties.
Given the complexity and dynamic nature of construction projects, having a conformed contract ensures that all parties have a common understanding of their rights and obligations, which helps in managing the project effectively. The conformed contract serves as the primary reference document for both parties throughout the duration of the project. It is used to resolve disputes, verify compliance, and manage performance and in the case of disputes or legal proceedings, the conformed contract is considered the definitive record of the agreement between the parties.
The process of conforming the contract typically involves updating the original contract documents by incorporating all subsequent amendments, supplementary agreements, and clarifications, ensuring they are consistent and accurately reflect the final terms.
