BSR register of high rise residential buildings

Under the Building Safety Act (BSA) 2022 high rise residential buildings maybe referred to as higher-risk buildings, because they pose greater potential risks to the safety of occupants and the public due to their height, occupancy, use, and construction materials. Buildings that are 7 storeys or are at least 18 metres high and have two residential units are considered to be higher-risk buildings.

Care homes and hospitals are also included as higher-risk buildings, as well as those consisting entirely of a secure residential institution, hotel or military barracks, but also the Secretary of State has the power to flex the regime to apply to new circumstances (including new building safety risks) in the future.

The Building Safety Regulator (BSR) established under The Building Safety Act 2022, regulates higher-risk buildings and aims to raise safety standards of all buildings, improving professional competence and helping professionals with design, construction, and building control, it is part of the Health and Safety Executive (HSE). The Building Safety Regulator (BSR) holds information about high-rise residential buildings in England falling under a regulatory framework aimed at improving safety and standards (Higher-Risk Buildings (Descriptions and Supplementary Provisions) Regulations 2023).

Buildings that fall into the category of higher-risk must be registered with BSR before people can live in them, this registration includes information about the building’s principal accountable person. This is the organisation or individual responsible for the safety of the building’s structure, external walls and roof. The principal accountable person needs to register the building with BSR, and inform it of any information it holds about the building changes and those responsible for the safety of the building’s common parts which are used by residents, such as corridors, lobbies and staircases. Other information held by the BSR register of higher risk residential buildings includes the height, the number of floors and when it was built.
